Do public schools have the right to force a student out?

My brother’s school is apparently "forcing" him out. Can public schools do that? They want him to transfer to another school. Do public schools have the right to do that?

If he has violated the rules and has a repeat pattern of being disruptive or abusive to staff and other students – then YES.

If not – find a good attorney.

The question is, why are they doing this? Do they have school boundaries and he falls outside them? Does his course call for special subjects that are taught in other schools but not in this one? Is he a behavior problem? Schools do have the right to move students around, but they have to have a good reason to do so. You are a little vague in your reasons as to why they want him to move.

He is guaranteed a free education, but he does not necessarily get to choose where. If he is a problem or can not have his educational needs met where he is, they certainly can move him but your parents would still be involved in the process.

What are the reasons that your brother is being forced to transfer to another school? A transfer is not a denial of an education. Is it for his safety or for the safety of others?

You family has the right to consult with an attorney if they think that the transfer is improper.

in some cases yes, you didn’t say how old he is, there is an age limit . is he a discipline problem ? these are some examples of legitimate reasons to force him out. in both cases he forced himself out.
